Bosnia and Herzegovina EC/BiH/05/034 Service procurement notice 1. Publication reference: EuropeAid/121501/C/SV/BA 2. Procedure: Restricted. 3. Programme: Cards 2005. 4. Financing: BGU-B-2005-22.070100-C1- ELARG. 5. Contracting authority: European Commission, on behalf of beneficiary country. Contract specification 6. Nature of contract: Global price. 7. Contract description: The overall objective of the project is to provide a master degree programme (at least 15 seats) and intensive courses (at least 50) to a limited number of BH citizens in public administration and EU law and integration. 8. Numbers and titles of lots: n/a. 9. Maximum budget: EUR 500 000. 10. Scope for additional services: Subject to availability and approval of further new funds, as well as performance of the contractor, an additional period not exceeding 24 months may be granted with a new budget not exceeding the total of the original contract. Conditions of participation 11. Eligibility: Participation is open on equal terms to all natural and legal persons of the EU Member States, Cards countries, Romania, Bulgaria and Turkey in accordance with the regulation governing the programme identified in point 3 - see Annex A2 of the Practical Guide to contract procedures financed from the general budget of the European Communities in the context of external actions. 12. Candidature: All eligible natural and legal persons (as per point 11 above) or groupings of such persons (consortia) may apply. A consortium may be a permanent, legally established grouping or a grouping which has been constituted informally for a specific tender procedure. All members of a consortium (i.e., the leader and all other partners) are jointly and severally liable to the contracting authority. The participation of an ineligible natural or legal person (as per point 11) will result in the automatic exclusion of that person. In particular, if that ineligible person belongs to a consortium, the whole consortium will be excluded. 13. Number of applications: No more than 1 application can be submitted by a natural or legal person (including legal persons within the same legal group), whatever the form of participation (as an individual legal entity or as leader or partner of a consortium submitting an application). In the event that a natural or legal person (including legal persons within the same legal group) submits more than 1 application, all applications in which that person (and legal persons within the same legal group) has participated will be excluded. 14. Shortlist alliances prohibited: Any tenders received from tenderers comprising firms other than those mentioned in the shortlisted application forms will be excluded from this restricted tender procedure. Shortlisted candidates may not form alliances or subcontract to each other for the contract in question. 15. Grounds for exclusion: As part of the application form, candidates must submit a statement to the effect that they are not in any of the exclusion situations listed in Section 2.3.3 of the Practical Guide to contract procedures financed from the general budget of the European Communities in the context of external actions (available from the following Internet address: http://europa.eu.int/comm/europeaid/ index_en.htm). 16. Subcontracting: Subcontracting will be allowed to the maximum of 10 % of the contract value. 17. Number of candidates to be shortlisted: On the basis of the applications received, at least 4 and at most 8 candidates will be invited to submit detailed tenders for this contract. Provisional timetable 18. Provisional date of invitation to tender: October 2005. 19. Provisional commencement date of the contract: January 2006 with a possibility of extension. 20. Initial period of execution and possible extension of the contract: 30 months. Selection and award criteria 21. Selection criteria: The following selection criteria will be applied to candidates. In the case of applications submitted by a consortium, these selection criteria will be applied to the consortium as a whole: 1) Economic and financial standing of candidate (based on item 3 of the application form): a) the average annual turnover of the candidate must exceed 5 times the maximum budget of the contract. 2) Professional capacity of candidate (based on items 4 and 5 of the application form): a) at least 10 academic staff currently work for the candidate teaching in fields related to this contract; b) the candidate must be an institution of higher education accredited within the Member State of its registration to provide post-graduate qualifications (UK masters degree level or EU equivalent standard). 3) Technical capacity of candidate (based on items 5 and 6 of the application form) (note: with reference to item 6 of the application form: the referred format requires the candidate to detail the 'projects' undertaken by the candidate as a means of demonstrating the candidate's technical capacity. For the purposes of this application and to facilitate the evaluation of the relative strengths of the candidates, the term 'project' shall be defined as an established post-graduate course leading to a masters qualification equivalent or above, and/or established intensive study programmes available to graduates. For each such 'project' declared by the candidate in item 6, the following information shall be required for the evaluation - listed topics covered by the masters or intensive course, the average number of lecturers contributing (average of 3 years), the average number of students attending (average of 3 years) and the percentage of 3rd-country nationals, the number of years for which the programme has been provided): it is compulsory for the candidate to satisfy the requirements of components 1 and 2: a) Component 1 - the candidate must be able to provide a masters degree qualification in the area of public administration and must be able to provide intensive short-study courses (e.g. summer courses) tailored to the needs of BiH on associated topics. The masters degree course must have been established and practising for a minimum of 5 years (since and including 2000) (refer to note on item 6 of the application form above); b) Component 2 - the candidate must be able to provide masters degree qualifications in subjects relating to European integration, including economics, law, public administration and politics and must be able to provide intensive short-study courses (e.g. summer courses) tailored to the needs of BiH on associated topics. The masters degree course must have been established and practising for a minimum of 5 years (since and including 2000) (refer to note on item 6 of the application form above); c) for all components, all courses are to be residential and the candidate must provide for all administrative and logistical requirements of the student, including travel, full board and accommodation, Internet access, and insurances; d) the presence of second language skills in BiH is predominantly English and therefore all candidates must be capable of providing tuition primarily in the English language and, in the event that BiH nationals (who are selected primarily on the basis of their potential to contribute to the overall objective of the contract) are unable to sufficiently master the additional required language, the candidate will be capable of supplementing the students' education with additional tuition delivered in English. The candidate should confirm in its application that it has the capability to meet this requirement. If more than 8 eligible candidates meet the above selection criteria, the relative strengths and weaknesses of the applications of these candidates must be re-examined to identify the 8 best applications for the tender procedure. The only factors which will be taken into consideration during this re-examination are: 1) number of relevant projects, i.e. courses (see note above for definition of a project) carried out in the past 3 years (2002, 2003, 2004); 2) percentage of 3rd-country nationals taking part in the courses; 3) number of years for which the programme has been provided. 22. Award criteria: As specified in the tender dossier annexed to the letter of invitation to tender which will be sent to shortlisted candidates. Application 23. Deadline for receipt of applications: 10.10.2005 (16.00), local time. Any application received after this deadline will not be considered. 24. Application format and details to be provided: Applications must be submitted using the standard application form (available from the following Internet address: http://europa.eu.int/comm/europeaid/ index_en.htm), whose format and instructions must be strictly observed. Any application which does not observe these provisions will be automatically eliminated. Any additional documentation (brochure, letter, etc.) sent with an application will not be taken into consideration. 25.
